Charte d'engagement


ARTICLE 1: PURPOSE OF THE CHARTER

Within the framework of the certification of accommodation made available to students in the Le Havre metropolitan area, this charter defines the obligations of landlords towards the AHLOET association, as well as the association's commitments towards landlords.

 

ARTICLE 2: DEFINITION

The property offered for rent may be a room, a flat or a house.

This rental must meet the minimum conditions of comfort and habitability (Decree No. 87-149 of 6 March 1987) and decent housing (Decree No. 2002-120 of 30 January 2002), compliance with which is the responsibility of the lessor.

The ‘Student Accommodation Quality Label’ is awarded on a per-property basis for a period of one year.

The owner undertakes to maintain the rented premises at a level of comfort that complies with the Charter at all times.

In the event of non-compliance with these obligations, the labelling body reserves the right to withdraw the label.

The certification body and its representatives cannot be held responsible for safety defects in certified accommodation, nor for any disputes between landlords and tenants.

A contribution of £25 per accommodation per year towards administrative costs will be requested from landlords whose accommodation is certified and advertised on the website.

ARTICLE 3: ADHERENCE TO THE CHARTER

At the Owner's request, the rental property shall be inspected by a representative of the certification body, who shall complete a detailed property inspection form.

In accordance with the ‘Alur’ law of March 2014, the Owner must attach to the rental agreement a technical diagnostics file including the Energy Performance Diagnosis (DPE) and the Natural, Mining and Technological Risks Report (ERNMT). It must also include an electricity and gas diagnosis for installations over 15 years old, an asbestos diagnosis for buildings constructed before 1997 and a Lead Exposure Risk Report (CREP) for properties built before 1949. These diagnoses must be carried out before certification can be obtained.

The reports of the visits are confidential and kept by the certification body.

After review by the commission, the owner is notified that they have been awarded the ‘Student Housing Quality Label’, subject to payment of the membership fee.

Upon receipt of the notification, the owner can advertise the ‘Student Housing Quality Label’ to students.

Adherence to the Charter is voluntary.

The commitment is renewable from year to year, subject to payment of the annual membership fee, unless it is terminated by either the Owner or the certification body.

 

ARTICLE 4: CLASSIFICATION

The ‘Student Accommodation Quality Label’ is awarded based on the labelling criteria defined below and the overall assessment of the accommodation using the inspection form.

 

Facilities:

The accommodation has at least one main room with either a minimum living area of 9m² and a ceiling height of at least 2.20m, or a minimum living space of 20m³.
Coherent layout of the rooms in the accommodation (location of toilets, etc.)
The accommodation has an indoor kitchen area equipped with a sink connected to hot water, cold water and waste water drainage, and can accommodate a cooking appliance (outside the bedroom).
The accommodation is equipped with separate sanitary facilities (toilet, shower, washbasin) inside the accommodation (outside the bedroom), supplied with hot and cold water and guaranteeing privacy.
Access to an active telephone line or an internet connection solution.
The technical diagnostics file is complete and valid.

Hygiene:

Compliance with health and decency standards
Quality of insulation and ventilation
The main rooms have sufficient natural light and access to fresh air
Condition of floors, walls, ceilings and woodwork
Condition of sanitary facilities
The accommodation is not subject to any unfitness or danger orders

Safety:

Safety of the surrounding area, the building and the accommodation
Quality and maintenance of the building, stairwell and common areas
The accommodation has a compliant electrical installation, providing sufficient lighting in all rooms and enabling the operation of standard household appliances
The accommodation has a normal heating system, suited to the characteristics of the accommodation
The building complies with fire safety standards
The accommodation is equipped with a standard smoke detector

The above elements are essential for obtaining the ‘Student Accommodation Quality Label’.

This label is awarded for one year, subject to compliance with the Charter, until the maintenance visit. After this visit, the labelling body reserves the right to maintain or withdraw the label.

The certification body reserves the right to carry out spot checks on the accommodation to verify the owner's compliance with and proper implementation of the charter.

Any changes made to the rental property by the owner that are likely to affect the level of comfort must be reported to the certification body (interior or exterior renovation work, etc.).

In the event of transfer or sale, the member Owner must notify the certification body.

The Owner undertakes to inform the certification body when their property is no longer available for rent, regardless of the reason.

 

ARTICLE 5: RENTAL - PRICES

Prices include rent and charges and are communicated annually to the certification body responsible for advertising rentals.

A joint inventory must be carried out at the beginning and end of the Tenant's tenancy in the presence of both parties.

All rentals shall be formalised by the signing of a rental agreement in accordance with the regulations between the Owner and the Student Tenant.

The minimum rental period for a furnished accommodation to a student may be reduced to 9 months.

The Owner may not require a deposit exceeding one month's rent excluding charges for unfurnished accommodation and two months' rent for furnished accommodation.

In the case of a furnished rental, the tenant may give notice at any time subject to one month's notice, or three months' notice in the case of an unfurnished rental.

The deposit shall be refunded within two months of the Tenant's departure, or one month if the condition of the property at the end of the tenancy is identical to that at the start of the tenancy.

 

ARTICLE 6: REMOVAL FROM THE REGISTER

Failure to comply with the prices communicated annually by the Owner will result in immediate exclusion.

Any breach of the general terms and conditions of this agreement will automatically result in exclusion, loss of the ‘Student Accommodation Quality Label’ and all the benefits attached to it.

In the event of expulsion, the Owner of the rental property undertakes to no longer use the ‘Student Accommodation Quality Label’ for any activity of any kind and to return the documents provided to them when they were a member within a maximum period of one month after notification of expulsion.

Any fraudulent use of the ‘Student Accommodation Quality Label’ may be subject to legal proceedings.

 

ARTICLE 7: COMMITMENT

I, the undersigned, Mr or Mrs

• declare that I have read the Charter, freely accept its terms and undertake to comply with them.

• agree to provide the certification body with all relevant information concerning the past year (occupancy rate, tenants' educational background, unavailability of accommodation, etc.).

• undertake not to engage in any form of legally reprehensible discrimination against applicants for accommodation.

 

For its part, the certification body undertakes to implement the necessary measures for the development of the ‘Student Accommodation Quality Label’, in particular by making rentals available on its website and providing interested parties with the contact details of the owner or agent.
